Foreign investments in Russia became possible in the former USSR in 1987 when the legislation on joint ventures was first introduced. Among a variety of organizational forms of the transnational capital in Russia it is possible to distinguish three groups: organizational forms of transnational capital with establishing their legal status in Russia, i.e. setting up a legal entity (the company with foreign investments); organizational forms of transnational capital with establishing their tax status, without setting up a legal entity (Representations and Branches of foreign legal entities); the organizational forms of transnational capital based on contracts.
The companies with foreign investments can be established as a new firm in accordance with Russian legislation (independently — the enterprises, 100% belonging to the foreign investor, or with the local partner — joint ventures), or by share acquisition in the already existing Russian firm or adjoining of such firm. The businesses may also be set up as affiliated or dependent company. When setting up business foreign investors can control the market in the capital investments territory. Company with foreign investments and a foreign investor have a legal protection, guarantees and benefits according to Federal Law "About foreign investment into the Russian Federation".
