Accreditation of foreign representations and affiliates

Representation of a foreign company. Representative office.

The representation, as a rule, is opened by foreign investors who want preliminary study the market, to carry out marketing investigations, to find partners, to form a dealer network. The representation is not the Resident of the Russian Federation, has no right to be engaged in business and works for advertising. The representation is accredited for the term from one to 3 years in the Ministry of Justice, as a rule, it is the State Registration Chamber at Ministry of Justice of the Russian Federation. It is also possible to accredit the representation in the Chamber of Commerce and Industry of the Russian Federation. After accreditation the representation should be registered in tax body for further registration, tax payment to the budget of the Russian Federation and for accounting. The representations accredited in the State Registration Chamber get visa support from the State Registration Chamber for employees of representation and their families, but, hiring foreign employees, one should remember, that the representation is obliged to register them in Federal Migratory Service and to get for them a permission for work.

Affiliate of a foreign company. Branch.

The affiliate, unlike representation, has the right to be engaged in economic activities, therefore is opened, as a rule, by foreign investors who are ready to invest in concrete projects. The affiliate is accredited the same as representation (excluding the Chamber of Commerce and Industry) for the term from one to 5 years. The affiliate, as well as the representation, is not the Resident of the Russian Federation.
